                   	     ORDINANCE NO. 9481
                  
                  
                   AN ORDINANCE CLOSING AND ABANDONING AN ALLEY
                   LOCATED NORTHWEST FROM ORCHARD KNOB AVENUE,
                   BETWEEN McCALLIE AVENUE AND DUNCAN AVENUE, MORE
                   PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN
                   CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby 
closed
         and abandoned an alley located northwest from Orchard Knob 
Avenue,
         between McCallie Avenue and Duncan Avenue, more particularly
         described herein, and as shown on plat attached hereto and made 
a
         part hereof by reference:
                A 10 foot wide unopened alleyway beginnong on the
                northwest line of Orchard Knob Avenue 125 feet
                southwest of the intersection of the northwest line
                of Orchard Knob Avenue with the southwest line of
                McCallie Avenue (as now locate), and extending
                northwest 153.75 feet between parallel lines.  Said
                alleyway separates lots 6, 7, and 8, block 21, from
                lots 9, 10, and 11, block 21, Highland Park
                Addition No. 1, as shown by plat of record in plat
                book 1, page 23, R.O.H.C.  Tax Map No. 146J-S-15,
                16, 17, 18 and 19.
               
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this closure
         and abandonment is made subject to the following conditions:
                1. The reservation for Jupiter Industries, Inc.,
                   d/b/a Chattanooga Gas Company, of an easement
                   the width of the right-of-way for its gas main,
                   lines and other distribution facilities located
                   within the petitioned right-of-way, which must
                   be maintained for the use and benefit of its
                   customers.
               
                2. City of Chattanooga has a sewer located within
                   said right-of-way and reserves an easement the
                   width of the right-of-way for the purpose of
                   maintaining said sewer.
               
                3. The reservation of an easement the width of said
                   right-of-way for South Central Bell for its
                   existing facilities.
               
                4. The areas reserved for utility easements must be
                   kept free and clear of all structures.
               
                5. All existing easements are retained.
               
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage as 
provided
         by law.
